The petitioner seeks bail in connection with Sakri P.S. Case No. 25 of 2016 (G.R. No. 600 of 2016), registered under Section 392 of the Indian Penal Code.
The accusation is that on the basis of the fardbeyan of the informant, Sudhir Kumar Jha, first information report was instituted on 16.03.2016 against three unknown persons. In course of investigation, the name of the petitioner surfaced in the confessional statement of co-accused, Mukesh Kumar Yadav @ Mukesh Yadav, thereafter, the petitioner has been remanded in this case on 06.07.2019 from Nirmali P.S. Case No. 74 of 2017, since, then he is in custody in the present case. Submission is that in fact, the petitioner is accused in 17 cases in which he is on bail, due to that reason the police
Patna High Court CR. MISC. No.74631 of 2019(3) dt.17-03-2020 2/2 implicated him in the present case showing his name in the confessional statement of co-accused, Mukesh Yadav. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sakri P.S. Case No. 25 of 2016 (G.R. No. 600 of 2016) to the satisfaction of the Chief Judicial Magistrate, Madhubani, subject to the condition that out of two bailors, one must either be parent or close relative of the petitioner.
