The petitioners seek bail in connection with Kalyanpur P.S. Case No. 82 of 2017, G.R. Case No.3048 of 2017 for offences punishable under Sections 147, 148, 149, 323, 379, 307, 504 and 506/34 of the Indian Penal Code.
The allegation is regarding the accused persons including the petitioners herein having engaged in assaulting the informant and his family members and others resulting in injuries to the informant side.
Learned counsel for the petitioners submit that the present case arises out of a case and counter case and on account
Patna High Court Cr.Misc. No.28524 of 2018 (2) dt.09-05-2018 2/2 of family feud altercation has taken place between both the side, whereafter the accused persons had also received injuries. It is further submitted that the petitioners are languishing in custody since 15.3.2018 and are having a clean antecedent. Lastly it is submitted that there is no knife injuries and the injuries appear to be not grievous in nature.
Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on furnishing bail bon of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, East Champaran at Motihari in connection with Kalyanpur P.S.
