The instant writ application has been filed for directing the respondent No. 2, the Director, Secondary Education, Education Department, Patna, Bihar, to issue written permission to the petitioner to enable him to appear in the upcoming competency examination (Sakshamata Pareeksha) or, if not possible, to permit the petitioner with each and every facility as allowed to the cadre of "Exclusive Teachers" who have joined after qualifying Sakshamata Pareeksha. Any other relief for which the petitioner may be

It is submitted by the learned counsel for the petitioner, by referring to the statement made in the writ application, that due to the pendency of a case before the District Appellate Authority, the petitioner was not allowed to appear in the said examination. The pendency has now been cleared, and there is no impediment for the respondents to permit the petitioner to appear in the competency examination, which is to be conducted in the near future.

4. On the other hand, learned counsel for the State submits that there is already a representation pending before the District Education Officer, Muzaffarpur, which may be directed to be decided. If there is no impediment, appropriate directions may be issued to allow the petitioner to appear in the competency examination.

5. Considering the aforesaid, the representation filed by the petitioner before respondent No. 4, which is appended with the writ application as Annexure-P/2, is directed to be adjudicated within a period of six weeks from the date of receipt or production of a copy of this order.

6. It is made clear that if there is no impediment, the petitioner shall be allowed to appear in the competency
