KUMAR ORAL ORDER 10-09-2018 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in Special (N.D.P.S.) Case No. 01/18 arising out of Warisaliganj P.S. Case No. 353/17, registered for the offences punishable under Sections 20, 22 and 23 of the N.D.P.S. Act.

Allegation against the petitioner is of growing Ganja Plant inside the boundary wall of his house.

It is submitted that petitioner has falsely been implicated in the case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner was residing in Punjab for earning his livelihood. No one was present in the house at the time of recovery. The petitioner is in custody since 14.04.2018.

Patna High Court Cr.Misc. No.28587 of 2018 (3) dt.10-09-2018 2/2 Petitioner is sole accused named in the F.I.R. and twelve green plants of Ganja weighing about 100 k.g. were recovered from the house of the petitioner.

Considering the facts aforesaid and the fact that huge quantity of Ganja was recovered from the house of the petitioner, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

The petitioner may renew his prayer for bail after remaining one year in custody.
