1. Heard the parties.

2. The petitioner has challenged the order dated 08.07.2024 passed in Misc. Case No. 36 of 2024 by the District Magistrate-cum-Collector, Kaimur at Bhabua, whereby the claim of the petitioner for grant of fair price shop license has been rejected.

3. Learned counsel for the State submits that under the Rule 5 (iv) of the Bihar Targeted P.D.S. (Control) Order, 2016, the Commissioner is the Revisional Authority of the order

Patna High Court CWJC No.19324 of 2024(2) dt.31-10-2025 2/2 passed by the Collector in an appeal. He thus submits that the petitioner may be directed to file revision before the Commissioner as per the Rule 5(iv) of Bihar Targeted P.D.S. (Control) Order, 2016.

4. Considering the aforesaid submission, the present writ application is disposed with liberty to the petitioner to file revision before the Commissioner, Patna. If the revision is filed within 15 days, the Commissioner, Patna, shall dispose the same in accordance with law on its merit after giving opportunity of hearing to all concerned within a period of four months from the date of filing of revision along with condonation of delay petition.

5. With the aforesaid direction, the present writ application is disposed.
