ANJANA MISHRA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.09.2019 in connection with Barauli P. S. Case No.342 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recovery was not from the conscious possession of the petitioner. It is said that he was found fleeing from the place of occurrence and therefore, he was taken into custody. The petitioner is having also no criminal antecedents. In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on
