The petitioner apprehends his arrest in connection with Sourbazar P.S. Case No. 556 of 2018 registered for the offences punishable under Sections 341, 323, 364, 504, 506/34 of the Indian Penal Code.

Allegation as per F.I.R. is that the informant was forcibly abducted by accused persons and assaulted an brought to the village Laud in the house of one Shambhu Chaudhary and as the accused person started searching her, she was brought to the house of the accused person, who are father, uncle and covillager of the informant. Learned counsel for the petitioner submits that the petitioner is the driver of the Scorpio and there is no allegation against the petitioner of kidnapping, rather allegation of kidnapping is against other accused persons, who left her to the

Learned counsel for the petitioner further submits that there is no specific allegation against the petitioner. He further submits that the other co-accused persons have been granted anticipatory bail by this Co-ordinate Bench of this Court vide order dated 17.05.2019 passed in Cr. Misc. No.20361 of 2019 and the husband of the informant has already been granted anticipatory bail by the court below itself.

In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Sourbazar P.S.
