The petitioner seeks regular bail in connection with Sahiyara P.S.Case No.59 of 2019 registered for offences punishable under Sections 363 and 366A of the Indian Penal Code.
Allegation against the petitioner is of kidnapping by the petitioner of the minor daughter of the informant. Submission of the learned counsel for the petitioner is that the medial report discloses that she is major and even the statement under Section 164 Cr.P.C. discloses that on the pretext of love, the girl was taken . He is in custody for more than six months.
Heard learned A.P.P. who has opposed the prayer for bail
Patna High Court CR. MISC. No.75242 of 2019(2) dt.13-01-2020 2/2 on the ground that on the pretext of marriage she was taken and she was subjected to sexual intercourse also.. Having heard both sides and in view of submission as made above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Sitamarhi in connection with Sahiyara P.S.case No.59 of 2019 with condition to co-operate in disposal of the trial and appear as and when required and further condition that he will not threaten to the informant or his family members otherwise his bail bond shall be cancelled. With the above direction, this application is allowed.
