Petitioner apprehends his arrest in a case registered under Sections 467, 468, 406, 409, 120(B)/34 of the Indian Penal Code.
Complainant who is the private person had filed a complaint case in the court of C.J.M., Lakhisarai being complaint case No. 84C of 2018 in which he has made officials of central cooperative bank, Block Cooperative Extension Officer and Assistant Registrar as well as other officials accused.
It is alleged in the complaint case that in the financial year 2014-15 and 2015-16 for procurement of paddy, the

No.76022 of 2019(2) dt.26-11-2019 2/3 accused against the norms of purchasing 20 quintal of paddy has purchased 70-90 quintal from farmers having one or two acres of cultivable land. The allegations are vague and there is no specific allegation against any of the accused. It has been further alleged that on complaint filed by the complainant the enquiry was conducted by the District Co-operative Officer, Lakhisarai and he submitted his enquiry report dated 14.10.2017 upon which a direction was issued to lodge FIR against guilty persons.
It has been submitted on behalf of petitioner that in said report petitioner has not been found to have committed any irregularity and as such he was exonerated in said inquiry report. It is further submitted that accused No. 1 Managing Director has been granted anticipatory bail by a co-ordinate Bench of this Court as contained in Annexure-7. Petitioner is a government servant having no criminal antecedent. Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.76022 of 2019(2) dt.26-11-2019 3/3 satisfaction of learned court below in connection with Suryagarha P.S. Case No. 13 of 2019 corresponding to G.R.
