Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 76, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that petitioner came and asked her to withdraw the case or consequences would follow, further the petitioner again came on 21-2-2025 at 9 am and acted inappropriately with her, on alarm her son came, when Ashok gave orders to kill and petitioner assaulted her by lathi causing injury on head and Lalita abused.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that the informant alleges that petitioner came and asked her to withdraw the case, when petitioner is a person with clean antecedent. It is further submitted that petitioner's sides and the informant's sides are agnates and they live in the same house and are having dispute relating to property as such an altercation took place in which both sides assaulted each other, but then informant falsely alleges that on account of assault by Basudeo (petitioner), she suffered injury. It is also submitted that even presuming what has been alleged is true without admitting then the injury suffered by the informant has been opined to be simple in nature, as pleaded at para- 9 of the anticipatory bail application.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail
