JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 The petitioner seeks regular bail in connection with Digha P.S. Case No. 521 of 2019, registered for offences punishable under Section 414 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 13 and odd litres of liquor from the motorcycle and petitioner was apprehended on spot and one co-accused, who was driving the motorcycle succeeded in fleeing away.

It has been submitted on behalf of the petitioner that he has no criminal antecedent and has falsely been implicated in this case and the motorcycle, from which, the alleged recovery was made, does not belong to the petitioner and he has been in judicial custody for last three months.

Heard learned A.P.P. also.

No.76642 of 2019(2) dt.11-12-2019 2/2 Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for about ten months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Digha P.S. Case No. 521 of 2019 subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the Trial Court.
