2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 126(2), 115(2), 118(1), 109 of the B.N.S. and Section 27 of the Arms Act.

The case of the prosecution is the informant was going to his home and when he reached near the house of Ramesh Kumar Sinha (the petitioner), the petitioner and his son Rajneesh Kumar started firing at the vehicle of the informant. It is further alleged that the informant received injuries with the

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. It is also submitted that earlier a case has been filed by the wife of the petitioner against the informant for his illegal acts. It has also been argued that there are two injury reports on the record. On one injury report, which is said to be of Sub Divisional Hospital, Danapur, shows that there are multiple injuries bear signature of nobody. From perusal of this injury report, it transpires that the informant has received multiple burnt wounds. There is one more injury report of PMCH, which shows that there is no pellet injury on face, only found deposit of gun powder.
It is also mentioned in the injury report that the patient was primarily treated at PHC, Danapur and was then brought to PMCH. From perusal of the FIR, it is clear that the nature of allegation is general and omnibus. Regarding injury, there are two injury reports and injury of PMCH seems most reliable. It is next submitted that there is dispute between the parties from before. It is further submitted that the petitioner is languishing in judicial custody since 17.09.2024.

Patna High Court CR. MISC. No.85816 of 2024(3) dt.17-02-2025 3/3 counsel for the informant have opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rupaspur P.S. Case No. 622 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 2nd Danapur.
