====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Section 364(A) of the IPC.

The prosecution story, in brief, is that on 30.07.2019, some unknown criminals kidnapped the father of the informant and demanded ransom for his release.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 14.08.2019. The petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the

Patna High Court CR. MISC. No.76751 of 2019(2) dt.27-11-2019 2/2 present case. The petitioner is not named in the F.I.R. The victim has been recovered. He has not named the petitioner. Except for this, there is no circumstantial evidence to suggest the participation of the petitioner in the present case. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dehri, Rohtas at Sasaram, in connection with Rohtas P.S. Case No. 185 of 2019.
