The petitioner seeks bail in Paharpur P.S. Case No. 63 of 2018 registered under Sections 419 and 420 of the Indian Penal Code and Section 66 of the I.T. Act.

Petitioner was apprehended with knife sitting in the Maruti Swift Dezire Car and his two associates having number of ATM Cards were also apprehended after giving chase from the ATM kiosk who disclosed that they were indulged in withdrawing money from ATM by exchanging ATM cards of gullible account holder.

It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.28565 of 2018 (2) dt.09-05-2018 2/2 that the petitioner has been falsely implicated in the case. No ATM card has been recovered from the possession of the petitioner. There is no allegation of withdrawing any money from anyone's account by the petitioner. Petitioner has been languishing in custody since 10.03.2018. Anish Kumar Singh who was apprehended with 14 ATM cards has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 03.05.2018 passed in Cr. Misc. No. 26702 of 2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Paharpur P.S. Case No. 63 of 2018.
