JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 The petitioner seeks regular bail in connection with Hajipur Sadar P.S. Case No. 490 of 2019, registered for offences punishable under Section 414 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.

Allegation as per F.I.R. is that petitioner was arrested along with stolen motorcycle and there is recovery of one loaded country made pistol from the possession of the petitioner. It further appears that petitioner is an accused in three more cases of similar nature.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and the motorcycle in question belongs to his brother and has been in judicial custody for four and half months.

Patna High Court CR. MISC. No.75019 of 2019(2) dt.11-12-2019 2/2 Learned A.P.P. opposed the prayer for bail.

Having heard both sides, considering the facts and circumstances of the case, at this stage, I am not inclined to enlarge the petitioner on bail, however, once charge is framed the petitioner will be at liberty to renew his prayer for bail. This application is, accordingly, dismissed.
