Petitioner seeks bail in connection with Phulwari Sarif P.S. Case No. 775 of 2017 for offences punishable under Sections 436, 427, 34 of the Indian Penal Code.

The First Information Report, as lodged by the lady owner of the house who had alleged that her house has been burnt by some miscreants and the goods and articles of the tenant as well as of herself got burnt.

It has been submitted by the learned counsel for the petitioner that he is innocent, not named in the F.I.R. and as he was arrested in Phulwari Sarif P.S. Case No. 777 of 2017

Patna High Court Cr.Misc. No.28630 of 2018 (2) dt.11-05-2018 2/2 thereafter he has been made accused in many cases and remanded in the present case. He submits that nothing has been recovered from his possession and he is languishing in judicial custody since 05.03.2018.

However, learned APP for the State opposes the prayer for bail stating therein that he is involved in five more cases of similar nature.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on completion of three months in custody on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-cum-Sub-Judge- XV, Patna in connection with Phulwari Sarif P.S. Case No.775 of 2017 subject to the condition that one of the bailors would be a close relative of the petitioner having sufficient immovable property, who will file an affidavit stating his relationship with the petitioner.
