JUSTICE ARUN KUMAR ORAL ORDER 18-07-2018 Heard learned Counsel for the petitioner and the State as also the learned Counsel appearing on behalf of the informant. Petitioner, already in custody since 15.2.2018, seeks bail in Darauli PS Case No. 179 of 2017 registered under Sections 341, 323, 324, 307, 504 and 506 of the IPC.

The allegation in brief is that the petitioner stabbed in the abdomen of the informant's brother as he had disclosed name of the petitioner to the police in another occurrence. Learned Counsel for the petitioner submits that there is no repetition of blow by the petitioner, he has been in custody since 15.2.2018 i.e. for last five months.

Whereas learned Counsel appearing on behalf of the informant submits that the allegation itself discloses that the petitioner has criminal antecedent and he has given blow, the impact of the blow was so acute that it has caused grievous injury. Having considered the said facts and circumstances, as there is no repetition of blow by the petitioner, the petitioner, namely, Aurangjeb Khan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.28965 of 2018 (5) dt.18-07-2018 amount each to the satisfaction of ACJM III Siwan in connection with Darauli PS Case No. 179 of 2017 with the condition that the petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
