The petitioner seeks bail in Naubatpur P.S. Case No.687 of 2015 registered under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act. The prayer for bail of the petitioner was thrice rejected by this Court. By order dated 16.05.2018 passed in Cr. Misc. No.19751of 2018, the prayer for bail of the petitioner was rejected with a direction to the trial court to expedite the trial but the trial has not yet been concluded. A report has been called for. Learned Additional Sessions Judge II, Danapur, Patna who is in seisin of Sessions Trial No.400 of 2018 reported that seven prosecution witnesses have already been examined and the trial

Patna High Court CR. MISC. No.78719 of 2019(4) dt.23-06-2020 2/2 is stalled on account of non-availability of some certain documents such as post-mortem report, seizure list and inquest report. Since there is specific allegation of firing against the petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

The trial court is directed to hold the trial on day to day basis and conclude the trial within six months from the date of receipt of copy of this order.

The Sr.S.P., Patna and S.P./A.S.P., Danapur are directed to ensure the production of the documents to the trial court within two weeks from the date of receipt of this order and ensure the examination of all the witnesses in accordance with law within six months failing which necessary action will be taken against them.

Let a copy of this order be sent to the trial court, the Sr.S.P., Patna and S.P./A.S.P., Danapur for information and needful.

If the trial is not concluded within six months from the date of production of copy of this order, the petitioner may renew his prayer for bail.
