2. The petitioner apprehends his arrest for the offences alleged under Sections 316(3)(4)(5), 318(2)(3)(4), 319(2) and 351(2) of the BNS, 2023, registered in connection with Shastri Nagar P.S.Case No. 631 of 2024.

3. As per the prosecution case, the petitioner is alleged to have been made the Trustee of the Board in an unauthorized and illegal manner which was cancelled by the Hon'ble High Court. The petitioner misled the Board by suppressing the cancellation of his appointment and continued to discharge his duty as Trustee of the Board.

4. At the outset, the learned counsels for the opposite party nos. 2 and 3 have submitted that the processes under Sections 82 and 83 of the CrPC have been issued, as such, the petitioner is not entitled for anticipatory bail.

5. In view of aforesaid submission, this anticipatory bail petition is dismissed, in the light of the decision in the case of Prem Shankar Prasad Vs. The State of Bihar and Another (2021 SCC online SC 955).

6. However, if the petitioner surrenders before the court below and pray for regular bail, the same shall be considered and disposed of without being prejudiced by this order. (Nawneet Kumar Pandey, J) HR/- U T
