The petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323, 379,308,504, 506,34 of the Indian Penal Code in connection with Parwalpur P.S. Case No. 225 of 2019 (District-Nalanda). As per the allegation in the FIR, two accused persons including these petitioners are said to have had altercation with the informant as a result of which the accused Gope Yadav is said to have assaulted with lathi on the informant's head. It is further stated that petitioners also assaulted which caused injury. It is submitted by learned counsel
Patna High Court CR. MISC. No.74843 of 2019(2) dt.20-11-2019 2/2 for the petitioners that from the injury report of the informant it transpires that all the injuries have been found to be simple in nature. In so far as assault on the head is concerned, the specific allegation is against Gope Yadav and not these petitioners. The application for bail was opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, let these petitioners above named be enlarged on bail, in the event of their arrest or surrender within six weeks, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Parwalpur P.S. Case No. 225 of 2019(District -Nalanda) subject to the conditions stipulated under section 438(2) of the Code of Criminal Procedure.
