2. The petitioner seeks regular bail in connection with N.D.P.S. Case No. 14 of 2023 arising out of Nagar P.S. Case No. 164 of 2023 registered on 08.03.2023 lodged under Sections 8(c) of N.D.P.S. Act

3. As per the prosecution case, F.I.R. has been lodged against the present petitioner from whom there is an allegation that he was carrying the medicines containing N.D.P.S. substance.

4. Counsel for the petitioner submits the said material which has been recovered from the possession are more than the small quantity but less than the commercial quantity.

5. Counsel further submits that petitioner is innocent

Patna High Court CR. MISC. No.996 of 2024(2) dt.18-01-2024 2/2 and has committed no offence. He further submits that petitioner is in custody since 04.10.2023 having clean antecedent.

6. Learned counsel for the State opposes the prayer for bail.

7. Upon specific query made by this Court that whether charge has been framed or not, counsel for the petitioner submits that he is not aware of this fact that charge has been framed or not.

8. As such, this Court is not inclined to grant bail to the petitioner but liberty is hereby granted to the petitioner to renew his prayer for bail after framing of charge. (Dr. Anshuman, J) sunnykr/- U
