2. The petitioner seeks regular bail in connection with Kako P.S. Case No. 329/2023 lodged on 29.09.2023 under Section 636/366A of the Indian Penal Code.

3. As per the prosecution case, the FIR has been lodged against unknown with an allegation of kidnapping of the minor daughter of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. In fact, the petitioner is not named in the FIR, but his name has transpired in course of investigation by the police. After recovery, the victim got her statement recorded under Section 161 of the Code of Criminal Procedure wherein the victim has stated that she has

An affidavit to that effect has been field, as contained in Annexure P/2. The petitioner is in custody since 03.10.2023 having no criminal antecedent.

4. Learned counsel for the State opposes the prayer for bail.

5. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, VI, Jehanabad, in connection with Kako P.S. Case No. 329/2023, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
