JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-01-2020 Petitioner seeks regular bail in connection with Jokihat P.S. Case No. 303 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code. As per F.I.R., while the informant was going to Jokihat Office by motorcycle, he was pushed by some miscreants, and when he fell down, they have assaulted him and taken away mobile, sky bag, laptop and some other articles. Submission of the learned counsel for the petitioner is that though he was named in F.I.R., later on, his name transpires on the basis of confession. He is in custody for more than 04 and half months. Charge-sheet has alredy been submitted, but in spite of that he has not been put on T.I.P., though the informant claimed to be identified the co-accused persons. Heard learned A.P.P. on the ground that petitioner is a accused in two other cases also.

No.84274 of 2019(3) dt.28-01-2020 2/2 Having heard both sides, in view of the submissions, made above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Jokihat P. S. Case No. 303 of 2018, subject to the condition that he has to cooperate in the disposal of the trial and further condition that he has to appear before the Police Station of his local area for a period of 06 months, so that, the police may watch his conduct, otherwise, his bail bonds shall be cancelled.
Let a copy of this order be communicated to the S.P., Araria, for needful.
