2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 406, 420, 471, 468, 120B and other allied sections of the IPC.
3. As per the prosecution case, on the pretext of providing job, petitioner cheated Rs.2.40 lacs from the informant.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and have falsely been implicated in this case. As a matter of fact, petitioner is merely an employee of the Infosystem Company. However, petitioner is ready to refund Rs.1.60 lacs to the informant, without prejudice to his case.
5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya
Patna High Court CR. MISC. No.84463 of 2023(5) dt.13-05-2024 2/2 in Rampur Police Station Case No. 147 of 2002, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure on the condition that the petitioners would deposit Rs.1.60 lacs in the Nazarat of the Civil Court and shall file its receipt at the time of furnishing bail bonds.
6. Said deposit shall be subject to the outcome of the pending cases.
