1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with Buniyadganj P.S. Case No. 267 of 2024 dated 24.10.2024 registered for the offence(s) punishable under Section(s) 308(5) and 3(5) of the B.N.S, 2023.

The main submissions advanced by learned counsel for the petitioner are that this is second attempt of the petitioner before this court to get the relief of regular bail and he has renewed his prayer in the light of the liberty granted to him in the earlier rejection order, the petitioner's trial has started and upon him the charges have been framed vide order dated 23.07.2025 and two co-accused namely, Bablu Kumar @ Bhutali Bindas and Dhanesh Kumar carrying almost similar nature of allegation have been granted bail by this Bench. It is further submitted that the

No.85005 of 2025(2) dt.05-12-2025 2/2 petitioner and the informant are the co-villagers and in between them a good relation has been restored and the allegation of abduction and payment of alleged amount is completely false. It is lastly submitted that the petitioner has been languishing in jail since 18.12.2024 though he remained an accused in one case prior to the registration of the present FIR but he has been acquitted in that case and accordingly there is no criminal antecedent of the petitioner.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

Considering the aforesaid submissions and mainly the petitioner's custody period, stage of his trial and coupled with the relief of bail having been granted to two co-accused persons, this court is now inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Buniyadganj P.S. Case No. 267 of 2024.
