The petitioner seeks bail in connection with Ladaniya P.S. Case No. 236 of 2017 registered for the offences punishable under Section 414 of the Indian Penal Code.

The allegation in the present case is that when the Police had apprehended the accused person i.e. the petitioner herein one stolen motorcycle was recovered from the possession of the petitioner and the petitioner could not show valid papers of the said stolen vehicle, hence it is apparent that the petitioner was driving a stolen motorcycle.

The learned counsel for the petitioner has submitted that the petitioner is innocent and is languishing in custody since 26.11.2017.

Patna High Court Cr.Misc. No.32206 of 2018 (3) dt.23-07-2018 2/2 Per contra, the learned A.P.P. for the State has submitted that the petitioner was caught red handed riding a motorcycle and apart from that two other cases are pending against the petitioner.

Having regard to the facts and circumstances of the case, there is no merit in the present petition, hence the same is dismissed.
