====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 08-12-2025 Heard learned counsel for the petitioners, learned counsel for the informant and learned Additional Public Prosecutor for the State.

2. The petitioners are apprehending their arrest in a case in connection with Mahila P.S. Case No. 24/2025 dated 06.08.2025 registered for the offences punishable under Sections 85, 82(1), 91, 126(2), 115(2), 352, 351(2), 351(3) read with Section 3(5) of the B.N.S. and Section 3&4 of the D.P. Act.

3. As per the prosecution case, the petitioners and the co-accused person are alleged to have tortured the informant mentally and physically due to non-fulfillment of demand of

It is further alleged that during the pregnancy of the informant, her mother-in-law kicked on her belly due to which she gave birth to a dead child. When she became pregnant again, they tried to force her to abort the child and thretened to kill her and her child.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is general and omnibus allegations against the petitioners. It is further submitted that the petitioner no.1 is the father-in-law, petitioner no.2 is the mother-in-law and the petitioner no.3 is the cousin mother-in-law of the informant and they have no concern with the alleged offence. Learned counsel for the petitioners has further submitted that no any document has been filed on behalf of the informant regarding the termination of pregnancy. The petitioners neither demanded any dowry nor tortured the informant. The petitioners have no criminal antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for anticipatory bail of the petitioners.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their

No.82286 of 2025(2) dt.08-12-2025 3/3 arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned court concerned, Katihar in connection with Mahila P.S. Case No. 24/2025, subject to conditions as laid down under section 482(2) of the B.N.S.S.

7. The application stands allowed.
