Petitioner apprehends his arrest in connection with Khagaria P.S.Case No. 746 of 2017 registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code. Allegation against the petitioner is that he has collected Rs.85 lakhs and odd and not made any entry in the register. Submission of learned counsel for the petitioner is that the work of entry was assigned to the Accountant and not the petitioner and he has falsely been implicated in this case. He has drawn my attention towards page 25 of the petition, which is part of FIR itself, which shows that after enquiry only Rs.18,83,307/- was not found to be deposited by the petitioner. Heard learned APP also.

No.31199 of 2018 (3) dt.07-08-2018 2/2 Having heard both sides and in view of allegation of financial irregularities and not depositing money, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
