IG/Prison and Superintendent of Jail, Gaya are physically present in Court. They inform that the petitioner has already been transferred from Gaya Jail to Chapra Jail where trial of the petitioner is pending.
They are exonerated from personal appearance. Perused the counter affidavit filed by the State of Bihar through IG/Prison.
In the past, prayer for bail to the petitioner was refused for the reason that the petitioner and others were apprehended by the police on suspicion that they were going to commit dacoity. From possession of the petitioner, one country made pistol was recovered and the petitioner was found accused
Patna High Court CR. MISC. No.75665 of 2019(7) dt.24-02-2021 2/3 in 16 other cases of robbery and dacoity. Petitioner is in custody since 10.08.2018.
The supplementary affidavit filed by the petitioner would reveal that charges have already been framed on 07.01.2021. The case is running for prosecution evidence. Considering the criminal antecedent of the petitioner and nature of allegation, I am not inclined to enlarge him on bail for the present in connection with Bhagwan Bazar P.S.Case No.336 of 2018 pending in the court of learned A.C.J.M.-XI, Saran, Chapra. Hence, prayer is refused.
The learned Trial Court is directed to expedite and conclude the trial preferably within nine months. The learned Trial Court is directed to proceed with the trial without allowing any unnecessary adjournments to the parties.
The Superintendent of Police, Saran shall ensure production of all the prosecution witnesses before the learned Trial Judge in connection with Bhagwan Bazar P.S.Case No.336 of 2018.
In the event of non-production of the witnesses, an explanation shall be submitted by the Superintendent of Police, Saran after completion of the aforesaid period.
