2. The petitioners seek regular bail in a case registered for the offence punishable under sections 274, 275 of the B.N.S., 2023 and section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 845 litres of spirit liquor was recovered from village Kaijalpur Nut Toli near

Patna High Court CR. MISC. No.84722 of 2024(3) dt.14-02-2025 2/2 Kerwani.

4. Learned counsel appearing for the petitioners submit that the petitioners are innocent and have falsely been implicated in these cases. No incriminating material is recovered from the conscious possession of these petitioners. Petitioners are in custody since 19.10.2024. Charge-sheet is already been submitted in these cases. Petitioners have five criminal antecedents out of which in two cases he is on bail.

5. Learned counsel for the State has opposed the prayer for bail of the petitioners.

6. Considering the aforesaid facts of the case and also no recovery is made from the possession of these petitioners, prayer for regular bail of the petitioners are allowed. Let the petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned 3rd Special Judge, Excise, Saran at Chapra in connection with Maker P.S. Case No. 242 of 2024.
