JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-11-2019 The petitioner, who is in custody since 19.10.2019, seeks bail in connection with Gardanibagh P.S. Case No. 628 of 2019/Special Case No. 9231 of 2019, dated 19.10.2019, instituted for the offences under Sections 30(a) and 34 of the Bihar Liquor Prohibition and Excise Act, 2018. As the allegation stands, the petitioner was arrested with 45 bottles of liquor, each bottle containing 375 ml. of whiskey.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.75391 of 2019(2) dt.26-11-2019 2/2 that he has clean antecedent and his arrest in the present case is because of mistaken identity. The petitioner was only passing through the road when on a mistaken identity he was arrested.

Considering the period of custody of the petitioner and his clean antecedent, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Gardanibagh P.S. Case No. 628 of 2019/Special Case No. 9231 of 2019.

The application stands allowed.
