The petitioner seeks regular bail in connection with Parsa Case No. 99 of 2015, registered for the offence punishable under Section 395 of the Indian Penal Code. The allegation is regarding unknown miscreants having intercepted the vehicle of the informant whereafter they are said to have assaulted the informant and had then driven away with his vehicle.

The learned counsel for the petitioner submits that the petitioner is innocent, neither any recovery of the looted articles has been made from the possession or house of the petitioner nor any Test Identification Parade has been conducted so as to connect the petitioner with the alleged

Patna High Court CR. MISC. No.80227 of 2019(4) dt.19-12-2019 2/2 crime. Lastly, it is submitted that one criminal case is pending against the petitioner, however, he is on bail in the said case. The petitioner is stated to be in custody since 4.7.2019. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge 10th , Chapra in connection with Parsa P.S. Case No. 99 of 2015 (S.Tr. No. 67/17).
