2. The petitioner is apprehending arrest in connection with Atri P.S. Case No. 47 of 2017, registered on 31.03.2017, for the offences punishable under Sections 341, 323, 307, 379, 504 and 34 of the Indian Penal Code.

3. As per the prosecution, FIR has been lodged against four named accused persons, including the petitioner, against whom there is an allegation that they started abusing the informant, and the dispute pertains to the construction of a drainage system. The specific allegation against the present petitioner is that he assaulted the informant's wife with a khanti.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel

Patna High Court CR. MISC. No.84418 of 2024(3) dt.12-05-2025 2/2 further submits that a completely false case has been lodged against the petitioner and his family members. Counsel also submits that the antecedents of the petitioner are not clean, as two criminal cases are pending against him, in which he is already on bail.

5. Learned APP for the State opposes the prayer for bail and submits that there is a direct allegation of assault on the informant's wife against the petitioner.

6. In the present facts and circumstances, this Court is not inclined to grant anticipatory bail to the petitioner, therefore the bail application of the petitioner is hereby rejected.

7. However, if the petitioner surrenders within six weeks from today and prays for regular bail, then the Trial Court shall pass order on the surrender- cum- bail application of the petitioner on the same day without being prejudice of the present order and the Trial Court shall pass order on the merit of this case.
