2. The petitioner is in custody in connection with Muffasil P.S Case No. 58 of 2024 registered for the offences punishable under Sections 392 of the Indian Penal Code.

3. As per allegation in the FIR, petitioner along with four unknown accused persons has robbed the informant and snatched Rs. 5000/-, Bank Keys, Aadhar Card, Mobile Phone as well as the black colour Passion Pro motorcycle bearing registration no. BR09V4195.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next

Patna High Court CR. MISC. No.87644 of 2024(3) dt.04-04-2025 2/3 submits that nothing incriminating has been recovered from the conscious possession of the petitioner. During the investigation, no witness claimed that he has seen the petitioner committing the offence for participation in the crime. He also submits that no TIP has been held and charge-sheet has already been filed long back but yet no progress has been taken place. Moreover, the Section in which charges has been farmed is triable by Magistrate. It is also submitted that petitioner is in judicial custody since 07.02.2024 and possess two criminal antecedent.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR, impugned order dated 19.09.2024, It appears that charges have already been framed on 03.01.2025 but yet no witnesses have been examined till date, Moreover, the Sections in which charges have been framed is triable by Magistrate, So considering all aspects of the matter and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Muffasil P.S Case No. 58 of 2024 with condition that petitioner
