2. The petitioner seeks regular bail in connection with Gaya Muffasil P.S. Case No.433 of 2023 registered under Sections 356 and 379 of the I.P.C.
3. As per prosecution case, it is alleged that while the informant was going towards C.S.P. Kaiya from the Bank, two persons, on motorcycle, came from behind and snatched his bag containing Rs.2,60,000/-, one laptop and finger print device, and fled away.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to three criminal antecedents. The petitioner is not named in the F.I.R., however, during investigation, his name has
Patna High Court CR. MISC. No.84836 of 2023(2) dt.22-01-2024 2/2 surfaced due to his own confessional statement. There is no recovery from the petitioner. No Test Identification Parade has been done in this case. The petitioner is in custody since 29.08.2023.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Gaya in connection with Gaya Muffasil P.S. Case No.433 of 2023.
