====================================================== CORAM: HONOURABLE MR. JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-01-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Ramgarh P.S. Case No. 256 of 2019, disclosing the offence under Section 414 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

The petitioners are in custody since 22.10.2019. It is alleged in the First Information Report that the petitioners were apprehended by the Police while riding a Motorcycle and allegedly they disclosed the Police that they were guiding a Maruti Alto Car which was following them, loaded with huge quantity of illicit liquor. Subsequently, the car was also intercepted leading to recovery of 145 litres of foreign made liquor. Three persons were arrested by the

Learned counsel appearing on behalf of the petitionerd has submitted that two out of three persons who were found sitting in the car have been allowed regular bail by this Court by an order dated 12.12.2019 passed in Cr. Misc. 82307 of 2019. Considering the above submission, this application is allowed. Let the petitioners, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIIrd cum Special Judge, Excise, Kaimur at Bhabhua, in connection with Ramgarh P.S. Case No. 256 of 2019, subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail Bonds shall be liable to be cancelled.
