JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-11-2019 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State. The petitioner seeks Regular Bail in connection with Case No. 193 C2 of 2019, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
The allegation is regarding the recovery of 23.580 litres of illicit liquor from beneath the stair case of the house of the petitioner.
The learned counsel for the petitioner submits that the petitioner is a lady and has falsely been implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 29.10.2019.
Patna High Court CR. MISC. No.75156 of 2019(2) dt.25-11-2019 2/2 Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on Regular Bail.
Accordingly, the above named petitioner is directed to be enlarged on Regular Bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIcum-Special Judge, Excise Act, Begusarai in connection with Case No. 193 C2 of 2019.
