The petitioners seek bail in connection with Durgawati P.S. Case No. 267 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 307 of the Indian Penal Code.

As per F.I.R., the case of the prosecution in brief is that on refusal by the informant to let his cattle for grazing the petitioners along with co-accused persons having armed with Lathi-Danda and Guns encircled the informant party and firings made by co-accused Nasim Khan and Imram Khan hit the father of the informant and the informant, respectively, while the petitioners and other co-accused persons assaulted the family

Learned counsel for the petitioners submits that there is specific allegation against Nasim Khan and Imran Khan regarding the firing. There is case and counter case between the parties. Learned counsel for the petitioners further submits that the injury report shows that the injury is simple in nature. He further submits that the petitioners are in jail custody since 21.09.2019 and further submits that the petitioners have got no criminal antecedent.

In the facts and circumstances of the case, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Durgawati P.S. Case No. 267 of 2019.
