JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 06-03-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is seeking anticipatory bail in connection with Khagaul P.S. Case No. 65 of 2002 registered under Sections 395 and 397 of the Indian Penal Code, pending in the court of learned A.C.J.M. - 6th, Danapur.

Learned counsel for the petitioner submits that the allegations against the petitioner is totally false and he has been falsely implicated in this case with an intention to grab the amount, the petitioner has no role in the occurrence as alleged.

Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner submits that the

Patna High Court CR. MISC. No.76552 of 2019(3) dt.06-03-2020 2/2 supplementary Charge-Sheet was submitted and the petitioner was charge-sheeted showing him absconder. Considering the facts and circumstances of the case wherein it appears that the case in question was registered on 25.07.2002, though the petitioner was not named in the F.I.R. but in the supplementary charge-sheet filed on 31.07.2007 the petitioner was showing absconder, this court would not entertain the prayer for anticipatory bail of the petitioner.

This application is, thus, dismissed.

In case, the petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer for regular bail shall be considered on it's own merit without being prejudiced by the orders of this court.
