2. From the perusal of report dated 25.01.2024, as made available to this Court from learned Trial Court/Additional District Judge-V, Barh that out of ten prosecution witnesses four have already been examined and remaining six witnesses are given up by the prosecution. From the perusal of the said report, it appears that the delay is intentional and deliberate on behalf of the petitioner.

3. Having regard to submission and by taking note of the aforesaid reports, it nowhere appears that delay is on the part of prosecution/by Ld. trial court.

4. Accordingly, the present petition is rejected, however, learned Trial Court is directed to conclude the trial
