The petitioner is languishing in custody in connection with Masaurhi P.S. Case No. 691 of 2019, for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Allegation is regarding recovery of 30 litres of illicit country made liquor from the house of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent. It is further submitted that the petitioner is in custody since 22.10.2019.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where

Patna High Court CR. MISC. No.76340 of 2019(2) dt.29-11-2019 2/2 the case is pending in connection with Masaurhi P.S. Case No. 691 of 2019, Special Case No. 8564 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court below; and (b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
