The petitioner seeks bail in a case registered for the offence punishable under Sections 342, 366A of the Indian Penal Code.

Prosecution case is that on 18.09.2019, the informant has received information from mobile that her daughter Raj Nandani Kumari is absent in the school. The informant searched Raj Nandani Kumari and came to know that accused Sumit Kumar Singh has kidnapped her daughter and has confined in the residence of Amit Kumar Singh for the purpose of marriage. Learned counsel for the petitioner submits that the petitioner has never kidnapped victim and she used to come at

Learned counsel for the petitioner submits that victim girl who is aged about 16 years herself made statement before the Magistrate under Section 164 of the Cr.P.C. where she has not stated anything against the petitioner for kidnapping or abduction. She also admitted that last two years, she knowing this petitioner and she also used to talk on mobile phone and she also ready to marry with petitioner with consent of her parents after getting the age of majority. He further submits that petitioner bears no criminal antecedent and he is languishing in judicial custody since 19.09.2019. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Jamui in connection with Laxmipur Police Station Case No. 356 of 2019.
