JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-01-2020 This application, for grant of anticipatory bail, arises out of Khizersarai P.S. Case No. 235 of 2019, disclosing offences under Sections 341, 323, 308, 504/34 of the Indian Penal Code.

Allegation against the petitioner is of assault to the informant on his head.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and there is case and counter case between the parties and although there is allegation of assault, however, the injury sustained by the informant was found simple in nature.

Heard learned A.P.P. also.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above

Patna High Court CR. MISC. No.75947 of 2019(3) dt.06-01-2020 2/2 named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -IV, Gaya, in connection with Khizersarai P.S. Case No. 235 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
