The present application has been filed for modification of the order dated 30.03.2018 passed in Cr.Misc.No.18280 of 2018, by which the petitioner was granted anticipatory bail in connection with Risiup P.S. case No.07 of 2018, pending in the court of 7th Additional Sessions Judgecum-Special Judge, Excise, Aurangabad and the petitioner was directed to surrender and furnish bail bond in the court below within a period of six weeks.
It is submitted on behalf of the counsel for the petitioner that in the cause title of the order dated 30.03.2018
Patna High Court Cr.Misc. No.34753 of 2018(2) dt.21-06-2018 2/3 passed in Cr.Misc.No.18280 of 2018 the present address of the petitioner also be added.
Let in the cause title of the order dated 30.03.2018 passed in Cr.Misc.No.18280 of 2018, the present address of the petitioner be also inserted as "Amrendra Tiwari alias Amrendra Kumar Tiwari Son of late Jagdish Tiwari, Resident of Mohalla3209, Sigh Nagar, P.O. & P.S.- Phusro, (Bermo), DistrictBokaro (Jharkhand)". It is further submitted on behalf of the petitioner that due to aforesaid reasons the petitioner could not surrender and furnish his bail bond in the court below.
It is further prayed on behalf of the counsel for the petitioner that further time may be extended so that the petitioner could surrender and furnish bail bond in the court below.
Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, the period of surrender of the petitioner in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order will be the same.
Patna High Court Cr.Misc. No.34753 of 2018(2) dt.21-06-2018 3/3 The order dated dated 30.03.2018 passed in Cr.Misc.No.18280 of 2018, is modified to the extent as indicated above.
The modification application is, accordingly, disposed of.
