JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-12-2019 The petitioner superannuated on 01.04.2002. He was constrained to file the writ application for payment of post retiral dues and considering the nature of claim, the matter was placed before the Lok Adalat. Before the Lok Adalat, the respondents admitted that they shall make payment of entire dues of the petitioner in six equal installments at the interval of three months. Unfortunately, the dues of the petitioner has not been cleared as yet.

Counsel appearing on behalf of the University submits that the new Vice-chancellor has joined and after

Patna High Court CWJC No.24054 of 2019(2) dt.04-12-2019 2/2 joining, the regular Registrar of the University has proceeded on long leave and, as such, there is some difficulty in making payment.

Pension is not bounty and the officers, who are responsible for payment of post retiral dues have to keep in mind that their inaction in the matter of payment of pension is causing hardship to a retired employee.

In the present case, the petitioner is aged about 77 years at the evening of his life and when he is in need of money he has been deprived of his dues notwithstanding the assurance made on behalf of the University before the Lok Adalat. Under the aforesaid circumstances, the Court is constrained to direct the Vice-chancellor of the University to ensure payment of entire dues within a period of fortnight from today, failing which the Vice-chancellor of the University shall not draw salary until payment of the entire dues in terms of the undertaking before the Lok Adalat.

The writ application stands disposed of.
