JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-02-2020 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. The petitioners, being the married and unmarried sisters of the husband of the informant, are apprehending their arrest in a case registered for the offences punishable under Sections 406, 420 and 498A of the Indian Penal Code. The prosecution case, as per the written report of Rupam Kumari submitted to the Station House Officer of East Colony Police Station, Jamalpur, is to the effect that initially the marriage was negotiated with Pappu Kumar but it could not

Patna High Court CR. MISC. No.81908 of 2019(2) dt.14-02-2020 2/3 settled, but subsequently brother of Pappu Kumar namely, Pawan Kumar made proposal and married with the informant on 18.03.2019. Thereafter, co-accused Pawan Kumar deserted the informant. The sisters of the husband of the informant played active role in not allowing the informant to live in her matrimonial house.

It is submitted by learned counsel for the petitioners that the petitioners are married and unmarried sisters of the husband of the informant. The thrust of accusation is against the husband of the informant and in fact, the brother of the petitioners has of own married with the informant in a temple and petitioners did not participate in the marriage. Learned APP submits that the petitioners are named in the FIR with specific accusation.

Considering the thrust of accusation against the husband of the informant and petitioners are married and unmarried sisters of the husband of the informant, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief
