2. The petitioner seeks regular bail in connection with Barun P.S. Case No. 113 of 2023 for the offences registered under Sections 363, 366(A)/34 of the Indian Penal Code and Section 8 of POCSO Act.
3. As per the prosecution case, minor daughter of the informant had gone for practical examination but did not return and it is suspected that petitioner with the help of other coaccused persons kidnapped her with intention to solemnize marriage with her.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case on the basis of suspicion only. The informant in her
Patna High Court CR. MISC. No.613 of 2024(3) dt.31-01-2024 2/2 statement made under Section 164 Cr.P.C. has not supported the prosecution case and she has not made any allegation against the petitioner. Petitioner has no criminal antecedent. He is in custody since 23.08.2023.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Barun P.S.
