The petitioner is apprehending his arrest in connection with Kotwa P.S.case No.121 of 2019 registered for offences punishable under Section 394 of the Indian Penal Code. Prosecution story is of committing loot-mar with the informant and others while they were returning from Barat by some unknown miscreants and later on name of the petitioner transpired on the confessional statement of the co-accused. Submission of the learned counsel for the petitioner is that except the confession there is nothing against him . Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that in such type of case, judicial interrogation and the TIP is required.

Having heard both sides and in view of the facts and

No.82338 of 2019(2) dt.21-01-2020 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on its own merit.

With the aforesaid direction, this application is dismissed.
