02. In the present case, the petitioner seeks bail in connection with Paru P.S. Case No. 247 of 2025 registered for the alleged offences under Sections 126(2), 115(2), 74, 79, 109, 352, 303(2), 351(2), 351(3), 3(5) of Bharatiya Nyaya Sanhita, 2023.
03. As per prosecution case, the petitioner and coaccused, in a marriage ceremony, started teasing the daughterin-law of the informant. When opposed, they fled away from the spot. Thereafter, they attacked the house of the informant and assaulted the son of the informant, causing serious injuries to him and also took away gold and silver ornaments and cash Rs. 32,000/-. The second son of the informant was also assaulted by

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Learned counsel further submits that except for molesting the daughter-in-law of the informant, there is no specific allegation of assault against this petitioner. Allegation of assaulting the son of the informant is on co-accused, Mahesh Sahani. Other allegations are general, vague and omnibus against all accused persons. Learned counsel further submits that the petitioner and informant are co-villagers and there is some dispute over land. This case has been lodged after delay of 10 days and the FIR was sent to the court concerned after delay of 08 days. All these facts show the falsity of allegation. The petitioner is having antecedent of one case in which he has been granted anticipatory bail. The petitioner is in custody since 08.09.2025 and charge-sheet has been submitted.
05. Learned APP for the State opposes the submission made on behalf of the petitioner.
06. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that there is no specific allegation of assault against this petitioner to the son of the informant and further considering the

No.83027 of 2025(2) dt.08-12-2025 3/3 period of custody of the petitioner along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur (West)/court concerned in connection with Paru P.S. Case No. 247 of 2025, subject to the conditions mentioned in Section 480(3) of BNSS and the following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
