2. The petitioner is in custody in connection with Barahiya P.S. Case No. 143 of 2024 registered for the offence punishable under sections 457 and 380 of the Indian Penal Code, lodged on 06.06.2024 by the informant, Tunni Devi.
3. As per the prosecution story, the allegation is that the accused persons covering their faces as recorded in the CCTV footage committed theft in the house of the informant. The Informant raised suspicion after watching the CCTV footage about some accused persons and upon interrogation from them, the name of the petitioner cropped up. Further, the

4. Earlier, the bail application of the petitioner was rejected in Cr. Misc. No. 4731 of 2024 and this is the second attempt.
5. Learned counsel for the petitioner submits that due to criminal antecedent, he has suffered, is not going to indulge in any criminal activity and shall be diligently appearing in trial.
6. Learned APP opposes the prayer for bail submitting that earlier his bail application was rejected and he has also criminal antecedent.
7. Considering the submissions of the parties, allegations is there, he has remained in custody since 30.08.2024 when the petitioner was remanded in the present case, an undertaking has been given that he shall be diligently appearing in trial, in that background, this Court is inclined to extend him the privilege of bail.
8. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Barahiya P.S. Case No. 143 of 2024 subject to the following conditions: (i) one of the bailor should be the family

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall appear before the concerned police station every month for one year to mark his attendance and at the end of the period a certificate be submitted before the Trial Court;
(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) vinayak/- U T
